The Supreme Court slammed the Bihar government Monday, giving it 24 hours to amend its FIR in the Muzaffarpur shelter home case.
The court told the state government that children had allegedly been sodomised at the Muzaffarpur shelter home but that Section 377 had not been invoked against the accused.
“What are you (Bihar government) doing? It’s shameful. If the child is sodomised, you say it’s nothing? How can you do this? It’s inhuman. We were told that matter will be looked with great seriousness, this is seriousness? Every time I read this file it’s tragic.”

The court had asked the Bihar government why charges under Section 377 had not been filed in the case, to which the government replied that the matter was under investigation.
The court then said that if it found that offences chargeable under Section 377, the court would pass an order against the government since an FIR had not been filed under Section 377.
The court also slammed the Bihar government for not taking action against all the 14 shelter homes in the state where children were allegedly subjected to sexual abuse.
The Supreme Court also noted that the FIR filed by the Bihar government made no mention of the TISS report on the sexual and physical abuse of the girls and boys at the state's shelter homes.
