Another petition filed in Supreme Court seeking ban on nikah halala
Follow UsA month after the Supreme Court sought a response from the Centre on its stand on polygamy and certain forms of marriages in the Muslim community, another petition was filed today in the apex court seeking a ban on Nikah Halala.
The Supreme Court has tagged the matter with the earlier four petitions.
The Supreme Court had on March 26, referred the case to a Constitution bench to examine and adjudicate the validity of polygamy and certain forms of marriages in the Muslim community.
The apex court's decision came in response to a batch of petitions challenging Section 2 of the Muslim Personal Law (Shariat) Application Act, 1937, for recognising and validating the practice of Nikah Halala, Nikah Mutah and Nikah Misyar as well as polygamy.
Calling the practices as unconstitutional, senior advocates also demanded that the prevailing practices should be declared illegal.
